The purpose of the General Terms and Conditions is to define the mutual rights and obligations of both Parties in the various stages of ordering one or more products offered and sold on the Site. No purchase may be made on the Site without the Customer having first accepted the General Terms and Conditions.

The products offered and sold on the Site are exclusively intended to be sold to end consumers, whether individuals or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers.

Any user of the Site declares that they have the legal capacity to place an order on the Site and to use a bank card.

Perrine Taverniti may update the T&Cs at any time. You can review the current version of the T&Cs at any time by clicking on the link “General Terms and Conditions of Sale and Use – Legal Notices”. The T&Cs in effect at the time the sales contract is concluded and which you have accepted are those that are binding on you.

Each time you purchase products on the Site, you will be asked to confirm your acceptance of these General Terms and Conditions in effect on the date you place your order. These General Terms and Conditions are available for viewing before and at the time you are asked to confirm your acceptance. To confirm your acceptance

The General Terms and Conditions express the entirety of the parties' obligations. If a clause of the General Terms and Conditions is declared null or invalid by a decision having the force of res judicata of a competent court, the other provisions of the General Terms and Conditions shall retain their full force and scope.

 

Products

The Site allows you to order from Perrine Taverniti a selection of fashion accessories from the Perrine Taverniti brand, and in particular jewelry (hereinafter the “Product(s)”) online via the Internet.

Our Product offers and prices are valid as long as they are visible on the Site, within the limits of available stocks. Errors or modifications may exceptionally exist, particularly in the case of simultaneous orders of the same Product by several customers. In the event of unavailability of one or more Products after placing your order, we will inform you by e-mail or telephone as soon as possible, offering you either to order another Product presented on the Site as a replacement, or to cancel your order. In the event of refusal of replacement, all or part of your order will be canceled and you will be reimbursed within a maximum period of fourteen (14) days following the date on which you expressed your wish to cancel the contract and using the same method that you used to place your order.

We assume no liability in the event of out-of-stock or unavailability of Products for orders that we have not yet confirmed.

We reserve the right to change the Products offered on the Site at any time. In order to ensure better quality of service and availability of our Products to all Customers, Perrine Taverniti reserves the right to limit the quantity of Products that can be purchased by a customer, in compliance with the applicable provisions in this area, in particular those of Article L121-11 of the Consumer Code.

The Products sold on the Site are presented, photographed and described as faithfully and accurately as possible. We strive to ensure that the photos are faithful to the original Products. However, variations, errors or omissions are possible. Similarly, depending on the Internet browser or your computer equipment, and in particular due to technical limitations of color rendering, the colors of the items may not correspond to the actual colors. In this case, we cannot be held responsible for these non-substantial variations, errors or omissions in the photographs or graphic representations of the Products appearing on the Site. In addition to the photographs reproduced and illustrating the Products, the Customer is invited to consult the description of each Product to know its characteristics. As the Products are made by hand, slight variations may occur in the Products.

Ordering process

Product Selection

To select a product, click on “Add to cart”. You can order one or more products. If, after selecting one product, you wish to order another, click on “Continue shopping”. After selecting the product(s) you wish to purchase, click on “Place my order” to begin the ordering process.

• Product Refunds

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the Product back or until you have supplied evidence of having sent back the Product, whichever is the earliest.

However, the Customer's bank may take several days to process the refund to the Customer's bank card, depending on the banks' processing times. Perrine Taverniti is unable to speed up this process, which is beyond its control.

Restriction on the right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for orders of Products made according to the Customer's specifications or clearly personalized Products (for example, jewelry that has been engraved or that has undergone a size modification). 

Legal guarantees and commercial warranty

Legal guarantees

The Products sold on the Site are subject to the legal guarantee conditions provided for by articles L217-4 to L217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of all other guarantees.

• Legal guarantee of conformity

Perrine Taverniti undertakes to deliver to the Customer a Product that complies with the contract and is free from defects of conformity upon delivery of said Product, in the sense that the Product will be suitable for the use usually expected of a similar good and that it will have the characteristics presented at the time of sale. Perrine Taverniti is also liable for defects of conformity resulting from the packaging, assembly instructions or installation when this has been placed under its responsibility by the contract or has been carried out under its responsibility.

This warranty will only apply if the Customer requests it within two years of delivery of the Product. Any defects of conformity that appear within twenty-four (24) months of delivery are presumed to have existed at the time of delivery, unless proven otherwise.

The Customer may choose between repair and replacement of the Product unless one of these choices results in a manifestly disproportionate cost for Perrine Taverniti. If repair or replacement of the Product is impossible, the Customer may have the price paid refunded and return the Product or keep the Product and have part of the price refunded. The return, replacement or refund of the Product will be made at no cost to the Customer and does not prevent the possible allocation of damages if the Customer is entitled to them. The sale cannot be cancelled if the lack of conformity is minor.

The legal guarantee of conformity applies independently of the commercial guarantee described below. In the event of a lack of conformity, the Customer must return the Products under the conditions specified in the article below of the General Terms and Conditions entitled “Return of Products in the event of withdrawal, non-conformity or hidden defect”.

• Legal guarantee against hidden defects Perrine Taverniti undertakes to provide the Customer with a Product free from hidden defects that would make it unfit for the use for which it is intended, or that would reduce this use so much that the Customer would not have acquired it, or would have paid a lower price for it, if the Customer had been aware of them. This guarantee will only apply if the Customer requests it within two (2) years of discovering the defect.

In the event of a hidden defect, the Customer will have the choice of returning the Product and receiving a refund of the price and costs incurred by the sale or keeping the Product and receiving a partial refund. In all cases, it will be up to the Customer to prove that they meet the conditions of the warranty.

In the event of hidden defects, the Customer must return the Products under the conditions specified in the article below of the General Terms and Conditions entitled “Return of Products in the event of withdrawal, non-conformity or hidden defect”.

Commercial guarantee

The Products sold on the Site do not benefit from a specific commercial guarantee which is added to the legal guarantees referred to in the previous article.

Return of Products in the event of withdrawal, non-conformity or hidden defect

The Products must be returned to the following address: Perrine Taverniti 64, rue de Turbigo – 75003 Paris.

The Products must be returned in their original condition and packaging (the original box and if possible the shipping carton), accompanied by their purchase invoice or a copy in the case of a partial return. If packaging is missing, we reserve the right to charge you four (4) euros.

The Customer may be held liable in the event of depreciation of the Products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these Products.

We recommend that you take out the insurance offered by your carrier. We will not be liable for loss, misdirection, or late delivery of a Product you wish to return, as the risks of the transportation you choose and initiate rest solely with you.

Availability of spare parts

In accordance with Article L 111-4 of the French Consumer Code, Perrine Taverniti informs Customers that no period of availability of spare parts essential to the use of the Products is guaranteed. We will nevertheless make our best efforts to satisfy our Customers in the event of a request for one or more spare parts.

Limitation of liability

Under no circumstances may Perrine Taverniti be held liable for any damage that does not result from a breach by Perrine Taverniti of one of its obligations. In particular, Perrine Taverniti may not be held liable if the non-performance or poor performance of the contract is attributable to the Client, to the unforeseeable and insurmountable act of a third party or to a case of force majeure.

Waiver

It is agreed that any failure or waiver by one of the parties in the application of all or part of the commitments provided for in these T&Cs cannot constitute a modification of this agreement, nor generate any right whatsoever, nor even be interpreted for the future as a waiver of the commitment in question.

Evidence

The data recorded by the Site constitutes proof of all transactions between the Seller and its customers and in the event of a conflict, this data is considered valid proof of the content of the transaction.

Applicable law – Disputes

These General Terms and Conditions are governed by and interpreted in accordance with French law. In the event of a dispute, the French courts shall have sole jurisdiction.

Intellectual property
